System Came When the Doctor was Thirty

”Is this now a matter of the patient’s family pursuing a lawsuit?”

Tian Qi’s voice was filled with anger, but not directed at Lin Qianlong for being brainless. It was because he chose this critical moment to create trouble for the hospital and the county.

Lin Qianlong didn’t know the inspection team was coming. He was also acting for the patient’s benefit. In fact, the hospital had previously ”encouraged” developing new practices.

Neither the hospital nor the health department anticipated an inspection team would arrive, right?

Of course, the hospital also did not expect that the surgical techniques Lin Qianlong was performing in the emergency department could be elevated to such a high level.

Tian Qi continued, ”This case is classified as ’practicing beyond the allowed scope’ since it didn’t result in severe consequences. Do you all acknowledge this?”

”Dean Hu, on behalf of the county health bureau, I impose a stern warning on your hospital and a fine of 20,000 yuan. Do you accept this?”

Hu Qingyuan’s attitude was very correct, ”Our hospital accepts the penalties imposed by Director Tian and the higher authorities. We will make immediate corrections and pay greater attention to procedural regulations in the future.”

Tian Qi then stated, ”The relevant major medical personnel involved are ordered to suspend their practice for three months.”

”To be more specific, following our bureau’s report to higher authorities for verification, the higher authorities have instructed that Vice Director Physician Lin Qianlong’s practice be suspended for three months.”

”Vice Director Physician Zhang Tiesheng and Attending Physician Lu Cheng are given a warning and a suspension from practice for a week, alongside any hospital-level internal notifications and penalties.”

”Do any of the doctors here have other views or objections regarding this?”

Hu Qingshan quickly responded, ”Director Tian, our emergency department is already understaffed. If Vice Director Physician Zhang and Attending Physician Lu Cheng are suspended, we really cannot operate normally.”

”We hope the bureau can take this into careful consideration based on this aspect.”

Tian Qi sighed and put away his documents, ”We actually do not want to impose such penalties, but this is the result given by the higher authorities. We are merely responsible for conveying it.”

Tian Qi continued, ”I’d like to remind you that previously, Professor Chen Song legally and compliantly performed Spleen Preservation Surgery in your department.”

”He was authorized by his institution to conduct off-site consultations and legally practice within the medical alliance.”

Zhang Tiesheng, upon hearing his involvement, asked, ”Director Tian, we were just assistants. Do we also have to bear a penalty?”

Tian Qi, having put away the documents, scratched his head and said, ”Whether you were the primary surgeon or not, since it was discovered, some form of penalty must be imposed.”

”Just earlier I asked all of you, and you said you weren’t aware of these things. As clinical doctors, you have the obligation not to participate in illegal activities.”

”Your lack of knowledge doesn’t justify your participation. According to regulations, you should fulfill the duty to dissuade and not participate.”

”Of course, a warning is certain. As for the specific decision on practice suspension, we will feed back to the county hospital’s actual situation and see if higher leadership might make an exception.”

”This time, the main factor was that the patient didn’t experience an accident.”

Right then, Director Huang Haibo suddenly spoke up, ”Director Tian, in the classification of medical personnel practicing beyond their scope, there are only two types: practicing beyond the professional scope and practicing beyond the location of practice.”

”What you just mentioned does not fit either category?”

Tian Qi, upon hearing this, glanced at Director Huang Haibo.

”Who is this?” Huang Haibo glanced at Hu Qingshan.

”This is Director Huang Haibo of our emergency department. He is also the deputy director of the emergency department.”

Tian Qi then explained, ”Director Huang, their situation is classified as practicing beyond the scope due to conducting a new surgical technique. It does not necessarily have to be beyond the professional scope.”

Huang Haibo continued to shake his head, ”No, no, Director Tian, practicing beyond the scope pertains to an unregulated scope of practice.”

”If a new surgical technique is strictly considered, it falls under ’unauthorized surgery’ situations.”

”Director Lin didn’t exceed his surgical specialties, so he shouldn’t be classified as ’practicing beyond the scope’!”

”Moreover, based on the case data I acquired, the patient’s situation indeed involved a splenic rupture at the time. Therefore, during the emergency reception, Director Lin and his team performing hemostatic suturing is indeed one of the standard emergency surgical rescue techniques.”

”Why was it classified as another surgical technique and a new surgical technique?”

”Spleen suturing is indeed one of the most effective treatment methods for hemorrhage due to splenic rupture?”

”According to the relevant medical regulations, in particularly critical situations, emergency medical aid to patients; ’practicing beyond the scope’ and ’unauthorized surgery’ can be exempted from liability.”

”Based on the existing case data, we can determine that the patient was in a particularly dangerous condition at that time. Thus, providing emergency hemostatic treatment is reasonable, legal, and consistent with medical protocol.”

”If a violation must be accounted for, it should be due to Director Lin not strictly following the standard guide for surgical treatment, rather than unauthorized surgery.”

”Director Lin didn’t forego the Spleen Removal Surgery nor did he avoid administering hemostatic treatment; how can that be seen as a violation?”

Tian Qi, after intently listening, looked astonished at Huang Haibo, ”Director Huang, you?”

Huang Haibo replied, ”Oh, I have a certain understanding of medical-related laws and regulations.”

”The law states clearly that if it isn’t explicitly prohibited, it’s permissible. The medical regulations don’t specify that the treatment for all types of emergency cases must strictly follow the recommended surgical guidelines for rescue, so within the rescue process, the attending physician can, according to their understanding, take effective rescue measures under the premise of not violating the most basic principles of medical conduct.”
