Chapter 10 - Deal With Disney

In the world of entertainment, money talks, but equity screams.

She reached for her phone to call the home. ”Grant? Tell Marvin the Mouse House blinked. We have the green light. And tell him... tell him he gets his distribution cap.”

—

”Five percent? Aunt Nancy, five percent of the global gross?” Marvin’s voice held a note of genuine shock as he looked over the deal memo. He leaned back in the plush leather chair of the Meyers’ library, the weight of the document feeling surprisingly heavy in his small hands. ”Are you kidding me? Is this the kind of treatment a newcomer should expect? It feels... aggressive.”

Nancy was clearly amused by his reaction. She leaned against the mahogany desk, her eyes dancing with the fire of a woman who had just won a war. ”This is attributed to your father’s capital infusion and your Aunt Nancy’s renowned oratory skills, little shark. Naturally, it proves advantageous that Michael perceives you as a potential reincarnation of Shirley Temple, albeit with superior coiffure. Thus, we are looking at a compensation structure of 5% plus $300,000 for the dual lead role, alongside $100,000 for the screenplay..”

She stepped closer, her tone shifting to that of a seasoned mentor. ”However, Marvin, such conditions are a total exception. In this town, you are still a novice until the box office receipts say otherwise. Do not get too ambitious; the industry eats people who think they’re bigger than the machine.”

Marvin nodded slowly, but his mind was already three steps ahead, sifting through the technicalities. ”I understand. But Auntie... just to be absolutely clear: are we talking gross box office revenue sharing, or ’net’ profit sharing?”

In the ”Hollywood Ledger” was a place where dreams went to die and money went to disappear. There was a legendary, dark distinction between the two. ”Profit sharing” was a sucker’s bet; you could have a hit like Harry Potter or Forrest Gump gross hundreds of millions, and the studio’s ”creative accounting” would still find a way to show a paper loss, effectively zeroing out the backend for anyone not named Spielberg. Box office revenue sharing—”First Dollar Gross”—was the holy grail. It meant you got paid before the studio started deducting the cost of the caterer’s third cousin.

”Don’t worry,” Nancy said with a reassuring wink. ”I’m in the chair, and your dad isn’t exactly a clueless outsider. He invested in Jurassic Park through his private equity wing. He knows exactly where the bodies are buried in a studio audit.”

”Then I’m relieved,” Marvin beamed, his inner calculator whirring.

In his ”recycled” memory of the original timeline, The Parent Trap had grossed roughly $92 million on a modest $15 million budget. In 90s, the US dollar was a titan; $92 million had the purchasing power of nearly $200 million far above the late 2010s. A 5% cut of that gross would be a cool $4.6 million.

And Marvin knew, with his ”Incubus” charms radiating through the lens and the ”Prodigy” hype machine behind him, and a little bit of magic he could push that number even higher. He wasn’t just playing a role; he was casting magic on the global audience.

I. The Twenty-Seventh of September

Marvin Meyers turned eleven years old on a Friday.

It was not, by any external measure, a remarkable Friday. The California sky was the particular shade of cloudless blue it reserved for late September — warm still, but carrying in its margins the first whispered suggestion of autumn, a season Los Angeles acknowledged only reluctantly and incompletely. The neighborhood was quiet. The gardeners had come and gone. The Meyers household smelled of the good coffee Linda had brewed at seven and the faint, expensive trace of whatever arrangement of flowers Gail had placed in the entrance hall that morning.

By eleven o’clock in the morning, Marvin was sitting at the long mahogany table in his father’s study, watching a lawyer turn pages.

His name was Edward Holt — forty-three years old, Yale Law, seventeen years in entertainment litigation, a man whose reputation in the industry was built on the specific and cultivated skill of reading contracts the way a surgeon reads X-rays: with total, clinical, emotionless precision. He had been hired twelve days earlier at Grant Meyers’ recommendation, vetted through two intermediaries, paid a retainer that would have covered six months of a junior associate’s salary, and given forty-eight hours to review the Disney agreement before today’s signing.

He turned another page. The room was quiet except for the paper.

At the head of the table, Grant sat with his hands folded, watching Holt with the patient attention of a man who had spent twenty years in finance and understood that rushing lawyers was the same as rushing surgeons — technically possible, reliably catastrophic. Linda sat to Grant’s left, straight-backed, reading glasses on, her own marked-up copy of the contract open in front of her. She had read it twice the night before and made thirty-one annotations in the margins in her precise, professor’s hand.

Nancy sat across from Linda, one leg crossed over the other, a coffee cup balanced on her knee, watching the room the way she watched sets — with the broad, quietly calculating attention of someone who was always, on some level, directing.

And at the far end of the table, in a chair that was slightly too large for him, sat Marvin.

He was dressed in a white button-down shirt, dark slacks, and the leather shoes that Linda had polished herself that morning with a quiet, ceremonial care she hadn’t announced but that everyone had noticed. His hair was combed. His hands were flat on the table in front of him, still. His expression was composed in the particular way that his expressions were always composed — not forced, not performed, but settled. Internally organized. The face of a person who had already thought through everything that was about to happen and had arrived at the table having made his peace with it.

He was eleven years old today.

He looked, Grant had thought earlier that morning over the coffee he’d barely tasted, about thirty-five.

Holt reached the final page. He turned it. He read the signature block, then the exhibits, then looked up.

”The intellectual property assignment in Schedule C is broad,” he said. ”Disney takes full ownership of all derivative works, sequels, and adaptations arising from the primary work. That’s standard for this kind of deal, but I want to be certain you understand what broad means in practice.” He looked at Marvin directly, not at Grant, not at Linda — at Marvin. ”It means if they make a sequel to this film, they don’t need your permission and they don’t need to pay you beyond what’s already specified.”

”I understand,” Marvin said.

Holt held the look for a moment longer than was strictly necessary. In seventeen years of entertainment law he had sat across the table from actors, directors, showrunners, novelists, musicians, and one twelve-year-old chess prodigy who’d been offered a network special. He had never sat across from an eleven-year-old and found himself uncertain who, precisely, was the adult in the room.

”The compensation structure in Article Seven,” Holt continued, returning to his notes, ”is favorable. The upfront fee, the royalty percentage on net receipts, and the performance bonus threshold are all above what I would typically expect Disney to offer for a first-time production from an unproven director. Which suggests,” he glanced at Nancy with an expression of professional acknowledgment, ”that whoever negotiated this phase had significant leverage.”

Nancy smiled. It was the smile of someone who had expected exactly this observation and had decided in advance not to comment on it.

”My concern,” Holt said, ”is the marketing approval clause in Article Twelve. Disney retains sole discretion over all promotional materials, release strategy, and public communications relating to the film and its associated properties. The confidentiality provision regarding the author’s identity runs parallel to this. Meaning—” he paused, ”—if Disney decides to break the story on Marvin’s age and identity at a time or in a manner that differs from what has been discussed verbally, they are within their contractual rights to do so.”

The room was quiet.

”I’d recommend a side letter,” Holt said. ”Not enforceable in the same way, but it creates a documented understanding of mutual intent. Something that makes the agreed timeline explicit and on record.”

Grant nodded once. ”Draft it.”

”I’ll have it by end of day.”

Linda took off her reading glasses and set them on her copy of the contract. ”Is there anything else that concerns you, Edward?”

Holt considered this with the brief, honest pause of a man who took the question seriously. ”No,” he said. ”It’s a good deal. It’s a very good deal, actually, for someone in Marvin’s position.” He gathered his pages. ”I’d sign it.”

Grant looked at Linda. Linda looked at Marvin.

Marvin looked at the contract.

He had read it himself, three days earlier, in his room, with a legal dictionary open on his desk and a yellow notepad beside it. He had made fourteen notes. Twelve of them matched Holt’s. The other two were things Holt hadn’t flagged, which might mean they were inconsequential, or might mean Marvin had misread the clause, or might mean he had caught something a seventeen-year veteran had let pass. He had decided not to raise them today. There would be time. There was always time, if you were patient.

He picked up the pen.

He signed his name in the clean, confident script — not a child’s signature, rounded and careful, but something with forward momentum, a thing that looked like it was going somewhere.

He set the pen down.

Nancy let out a breath that was almost a laugh. ”Well,” she said softly. ”There it is.”

Grant reached across the table and put his hand briefly on Marvin’s shoulder — not squeezing, not performing, just placing it there. A quiet, solid weight.

”Happy birthday, son,” he said.

The lawyer began packing his briefcase. The afternoon light shifted through the tall windows. Outside, the neighborhood was still quiet, and the sky was still its irreproachable blue, and somewhere across the city, in a glass-and-steel tower in Burbank, the Walt Disney Company had just acquired something it did not yet fully understand.

---

The thing nobody told you about making a movie — the thing that existed in the space between the glamorous mythology of filmmaking and the unglamorous reality of it — was that the moment a contract was signed at the top of the house, approximately nothing happened immediately below it.

This was not negligence. It was not, precisely, incompetence. It was physics. Institutional physics — the particular inertia of a body so large, so internally layered, so thoroughly organized around its own perpetuation that any new directive, however clearly it originated from the very summit, had to travel downward through so many floors of interpretation, delegation, review, and counter-review that by the time it reached the people actually responsible for doing things, it had been diluted, amended, questioned, tabled, re-tabled, and sent back upstairs for clarification at least twice.

The Walt Disney Company in the autumn of 1996 was not, despite its mythology, a nimble organization. It was an empire. And empires, by their nature, moved like empires.

Michael Eisner had green-lit the project. This was, in the hierarchy of the studio, equivalent to God speaking from the burning bush. The mandate was clear, the authority unimpeachable, the intention explicit.

And yet — and this was the particular genius of institutional bureaucracy — the organizational apparatus that existed between Eisner’s word and the first day of principal photography was so extensive, so internally divided, and so richly populated with individuals whose professional survival depended on their ability to assert relevance, that the project’s entry into the studio system was less a clean ignition and more a slow, grinding, multi-stage engagement of gears that had not previously known each other existed.

It began with the question of which division owned it.
